There is a potential question as to legality in Spain and for the time being those feeds have been removed until we understand the situation better.

Well, finally reading the disposition 4950 from telecommunications, I find this paragraph under the heading of very serious infringements (Art. 76):

"10. The unauthorized interception of telecommunications is not intended for the public in general, the dissemination of content. "

I think this says it all.

Is it definite that the spanish feeds don't return to LiveATC? Are you studying its legality?
It would be one of the few countries that can't be heard.
A greeting and thanks for the effort.

For now it is definite.  The actual complainant is the air traffic controller association in Spain (Professional Association of Air Traffic Controllers).  When they aren't on strike this is what they spend their time focused on.

They cite Article 76.10 of the General Telecommunications Law, Law 9/2014 of May 9th (2014) (http:/www.boe.es/diario_boe/txt.php?id=BOE-A-2014-4950) which states that "the unauthorized interception or disclosure of telecommunications not intended for the general public" is classified as a very serious offence punishable with a fine not exceeding 20 million Euros."

They further state:

"This ban is based on the fundamental right to the secrecy of communications established under Article 18.3 of the Spanish Constitution (http://www.boe.es/buscar/act.php?id=BOE-A-1978-31229) in which "Except in the event of a judicial decision, the secrecy of communications is guaranteed, especially that of postal, telegraphic and telephone communications."  This right is further elaborated in Chapter III of Title III of the General Telecommunications Law, Law 9/2014 of May 9th"

So even though I don't see anything in the law relating to open over the air radio communications, apparently the air traffic controllers are unhappy and the government seems intent on prohibiting the activity.  It is debatable whether these communications can be considered "secret."  If they were ever intended to be secret they would have been encrypted long ago.

So that is why there are no feeds from Spain.
