At approx. 4:30 EST today while listening to PHL Approach I head someone call in and just say "call sign xxxx just had an aircraft miss me about 100 fee off of my nose"  

The controller said he did not see anything around him and then said he saw a faint blip behind the plane but the aircraft did not have their transponder on.  

The frequence switced over and I couldn't patch toget the rest of the conversation but curiosity is getting the best of me now.  What would the policy be if a GA aircraft hangs a South Jersey U-Turn and cuts off a commercial aircraft?  How would they track them?  What penalties would they expect to receive if cought?  Has this happened to anyone here?

The Mode-C vail is in place to prevent GA aircraft from flying around without transponders and conflicting with IFR traffic.  However, I can tell you that I frequently see aircraft operating without transponders or with inoperative transponders within a Class Bravo mode-C vail almost every day.

As for the penaties....I'm not sure.  Sometimes I'll see approach control track the primary target to an airport and then follow up with a control tower or airport management.  Most of the time though, there is no punitive action.  If FSDO were notified they would be the final authority in disciplinary action.

I have HEARD a pilot could face jail time, depending on the severity, and frequently loose there pilots licence for a 1 - 2 year term. Now don't hold me to that because, again thats what i have heard.
