Indulge me in an answer.

Ok I know there have been numerous discussions about scanners aboard flights and wheather or not it should be on or off in the cabin. I do not plan to listen to the radio on the flight going on Vacation to FLL but my question is which baggiage should I pack it in Carryon or Checked. Which would cause the lesser difficulty with the TSA ?

I checked the BA General Conditions of Carriage http://www.britishairways.com/travel/genconcarr1/public/en_us#8 and they ask you to put "personal electronic devices" in your carry on. (8f)
I would put earplugs and scanner in my carry on: "checking if the plane comes in" and other entertainment while at the airport.

TSA didn't give me a second look my last time through JFK with a radio shack pro-82.  At the gate, though, I did the ear phones coming out of my backpack thing just so people don't start looking at me funny.  It turned out fine, and got to hear a couple of my favorite controllers.

During flight you are not to have anything that transmits or recieves in use. I would hate to get in trouble just to hear a few minutes of ATC. As far as having the scanner in your carry-on and not using it I see no problem. Everyone on the flight will likely have a cell phone. If it is off no problem. I think carry on is fine. If you are courteous and upfront with the TSA you will not have a problem.
