Student..Question for Argumentation Class

 I know nothing about the rules of airspace and whatnot.  I've only flown 4 times in my life (two trips).  I am taking an Argumentation class in college right now in my prerequisites to go into a Nursing program at Fresno State.  Here is my topic that I am to debate:

In 1946, Roger was the owner of a chicken farm.  Everything was relatively fine until the Government bought a large tract of land adjacent to Roger's farm and built a military base.  The noise from the low-flying aircraft scared the chickens so badly that they stopped producing eggs.  Roger took the government to court seeking damages, claiming that they were responsible for trespassing in his airspace.

I am arguing on the side of the Government.  I'm just trying to gather information (intel) on what to back my argument up with.  So far, I have eminent domain.  Can y'all help at all?  It's ok if you can't, I'm going all over to get tidbits of info.
