I am looking for the advisory circular that sates a commercial pilot can not advertise him or her self out.

I think you're talking about the advisory circular that defines private carriage and common carriage.  That's AC 120-12A.  Find it here: http://www.faa.gov/documentLibrary/media/Advisory_Circular/AC%20120-12A.pdf  Otherwise, the FAR's do a pretty good job addressing what's okay and what isn't.  That's FAR 119.1, found here: http://www.ecfr.gov/cgi-bin/text-idx?SID=ea9dec61efa209867844a2f35debf7cb&node=pt14.3.119&rgn=div5#se14.3.119_11
