Nope, looks like aevins is correct. It appears that Fox News took the audio clip from here without giving Dave's site credit and they even have the audacity to publish this copyright statement at the bottom of their article with the clip, "Copyright 2008 Associated Press. All rights reserved. This material may not be published, broadcast, rewritten, or redistributed."
Consider the facts: The Fox NY audio link produces a downloaded MP3 file that is 31:44 in duration, 3,808,128 bytes in size, has an audio bitrate of 16kbps, and is tagged with the following text: "KJFK - KFK TOWER - JUL-06-2008-0030Z"
With the exception of Fox's audio clip file name (which is very easily changed), these listed file characteristics match exactly the file downloaded from LiveATC's archive.

man i wish the news would do an investigation on EVERY incident that happens DAILY around the country...it would be a 6-7 hour program.

Yup, NATCA, the AP, and FOX news all took the clip from our site without any contact with us. FOX even broadcasted it in a story yesterday.

It would have been courteous to acknowledge the source, but this site hardly owns the content.

The content, no, but the delivery method? Yes.
If I were to videotape a public scene, does my video tape automatically become public domain that can be taken by news organizations without my approval?
