They first had a stuck mic on depature from JFK and later they also had one on GUARD. They knew that they had it but could not fix it. New York Center were eventually able to talk to them on GUARD even though they did get a stuck mic there to.
At one point both NY approach and NY Center asked them to ident if they could hear them at the same time. NY Center asked on GUARD and that is the one they heard but when they did ident the approach controller also thought they could hear him.
